Housing Possession Claims

In relation to Possession Action at the County Court on the basis of Section 21 of the Housing Act 1988, the Notice periods given to tenants from 29 August 2020 to at the very least 31 March 2021 must be at least 6 months – The Coronavirus Act 2020 (Residential Tenancies: Protection from Eviction) Amendment) (England) Regulations 2020. The Notice periods are extended because of Covid-19 Pandemic.

There are certain cases where a shorter notice period may be provided such as in anti-social behaviour, fraud and where tenant has rent arrears to the value of 6 months rent.

If a valid notice is served and the tenant does not leave by the specified date, then an application for possession can be made at the County Court for a Possession Order.
